Terms & Conditions Max Fulfilment

Welcome to Max Fulfilment. By using our services, you agree to these terms and conditions. Please read them carefully so that you are fully aware of your rights and obligations.


1. Definitions

In these terms and conditions the following terms shall have the following meanings:

  • Max Fulfilment: The service provider that offers logistics solutions.

  • Customer: The person or legal entity that uses the services of Max Fulfilment.

  • Services: All logistics and fulfillment services offered by Max Fulfillment, including warehousing, shipping, returns processing, and additional services.


2. Applicability

  • These terms and conditions apply to all agreements between Max Fulfilment and the customer.

  • Deviations from these conditions are only valid if agreed in writing.


3. Services

  • Max Fulfilment offers logistics services such as storage, pick & pack, shipping, and returns processing.

  • Additional services, such as special packaging or labeling, are provided at additional costs as stated in the price list.

  • Max Fulfilment reserves the right to modify or discontinue services with prior notice to the customer.


4. Customer obligations

  • The customer is responsible for the correct and complete delivery of articles in accordance with the established delivery requirements.

  • The customer must accept the rates and conditions as stated in the agreement.

  • The customer is responsible for providing correct and complete information regarding orders and shipments in a timely manner.


5. Rates and payment

  • The rates for services are set out in the Max Fulfilment rate list.

  • Invoices are sent monthly in arrears and must be paid within 10 days of the invoice date.

  • In case of late payment, Max Fulfilment reserves the right to charge interest and collection costs.


6. Liability

  • Max Fulfilment is only liable for direct damage resulting from intent or gross negligence.

  • Max Fulfilment is not liable for indirect damages, such as lost profits, consequential damages or delays caused by third parties.

  • Max Fulfilment's liability is limited to the amount charged for the specific service that caused the damage.


7. Storage and risk

  • Items are stored in a secure environment. Max Fulfilment takes reasonable steps to prevent loss, theft, or damage.

  • The risk of loss or damage to the items remains with the customer, unless otherwise agreed in writing.


8. Termination

  • Either party can terminate the collaboration in writing, taking into account a notice period of 1 month.

  • In case of non-payment or violation of these conditions, Max Fulfilment reserves the right to immediately terminate the collaboration.


9. Confidentiality

  • Max Fulfilment and the customer undertake to maintain confidentiality of all confidential information exchanged in the context of the agreement.


10. Applicable law and disputes

  • Dutch law applies to all agreements.

  • Disputes are preferably resolved by mutual agreement. If this is not possible, disputes will be submitted to the competent court in the Netherlands.
